**Guarantee on all our e-mobility products:**
LavishApe gives you a 24-month warranty on material and construction defects on the frame and non-suspended front forks under normal handling, use and maintenance.
The warranty applies to all products in our online shop and stores. If a product purchased online is not free of defects, please contact us by phone at (+49) 0176 804 84 213 or by email at info@lavishape.de. For products that you purchased locally in one of our stores, please contact the respective seller.
**Wearing parts:**
The warranty is subject to special conditions for wearing parts. Wearing parts are not covered by the warranty if they have "worn out" through use. Here is an example: The electric scooter was delivered to the customer without any defects. Within the first 6 months, for example, the rim brakes are subjected to heavy use, so that the brake pads are worn down and need to be replaced. In this case, the brakes are not covered by the warranty, as this represents normal wear and tear through use of the electric scooter.
The following parts in particular are considered as wearing parts:
- Batteries, brake discs, brake pads, bushings, seals and bearings in chassis parts (fork, shock absorber), rims (for rim brakes), handles, bottom brackets, bearing sets for full-suspension frames, hub bearings, tires, pinions, headset, cables, saddle.
**Warranty conditions:**
LavishApe guarantees the first purchaser a two-year guarantee on material defects and processing errors ("defect") when purchasing a fully assembled vehicle. If a defect already exists when the risk is transferred or if it occurs during the term of the guarantee, LavishApe can, at its own discretion, remedy the defect ("repair") or deliver another new vehicle ("subsequent delivery"). In the event of a repair, LavishApe can, at its own discretion and choice, replace defective parts or repair them by means of labor. In addition, LavishApe is entitled at any time to have the repair carried out by a third party.
**Functional guarantee:**
The battery is guaranteed for six months. Defective batteries will be repaired or replaced (with a battery that has at least the same energy capacity as the replaced battery before the malfunction occurred). Damage that occurs as a result of the following activities is not covered by the guarantee:
- Exposing the battery or the entire vehicle to ambient temperatures above 50°C (122°F) or below -25°C (-13°F) for more than 24 hours continuously.
- Physically damaging the battery or intentionally attempting to extend (other than as specified in your documentation) or shorten the life of the battery, either through physical means, programming, or other methods.
- Contact of the battery with direct flames or moisture or flooding of the battery.
- The battery, like all battery systems, is subject to a gradual loss of energy and performance with continued duration and use. Loss of energy or performance of the battery over time or due to or as a result of battery use is NOT covered by this battery warranty.
- The term begins with the handover of the vehicle or with the registration of the vehicle, whichever occurs first ("transfer of risk").
**The following parts are excluded from the guarantee:**
- All parts subject to natural wear and tear (in particular but not exclusively: brake pads and brake discs, tires, shock absorbers, bulbs, paint, handles, saddle and seat post, bearings, seals).
- All parts and equipment not manufactured and/or installed by LavishApe or an authorized manufacturer.
- Operating and auxiliary materials (in particular but not exclusively: brake fluid, oils, greases, seals or other lubricating or hydraulic fluids).
- Accessories and special equipment which were not offered as part of the initial purchase of a new vehicle.
**Guarantee obligations do not exist if the defect and/or damage that has occurred is directly or indirectly related to:**
- Vehicle warnings and/or instructions in the owner's manual have been actively ignored and/or regulations regarding the proper operation, care or handling of the vehicle (see owner's manual) have not been followed.
- The vehicle was damaged by force majeure, deliberate or malicious acts (including by third parties) or by an accident.
- The vehicle was driven as part of motorsport or other competitions or the associated practice runs and was subjected to excessive stress.
- The vehicle was used improperly and/or illegally (contrary to road traffic and vehicle registration regulations). Any kind of intervention or manipulation was made in the drive, electric motor, controller, battery systems or software of the vehicle. All interventions to increase speed, as well as "tuning" the motor or controller, are illegal. In addition, the operational safety and possibly also the service life of the vehicle are reduced and insurance cover, the EC certificate of conformity and the guarantee are void.
**Damage caused by incorrect handling:**
Damage caused by improper handling, storage or lack of care, including water damage, damage caused by storage in a damp environment, damage caused by a short circuit, damage caused by deep discharge (battery discharged below 63 volts), damage caused by long-term storage with 100% battery level (SoC) and damage caused by charging with a defective or non-original charger, are also not covered by the warranty.
- Parts or accessories that have been installed or attached to the vehicle that have not been approved in writing by LavishApe or the vehicle has been modified in a way that has not been approved by LavishApe.
- Hydraulic fluids or lubricants have been used which are faulty or contain foreign bodies or which are not recommended or approved by LavishApe.
- Costs resulting from downtime of the vehicle, including direct or indirect or commercial losses suffered by the owner or user of the vehicle as a result, will not be reimbursed.
- There is no entitlement to warranty services if maintenance intervals or the maintenance plan have not been adhered to and the maintenance and repairs have not been carried out by an official LavishApe service partner. There is also no entitlement if the e-scooter is used for commercial purposes (in particular but not exclusively rental of the e-scooter, courier services, etc.).
This guarantee does not limit your statutory rights, in particular warranty claims against LavishApe and possible claims under the Product Liability Act against LavishApe.
